1. Acceptance of Terms

By accessing or using TurnUpTour and the official AKTHESAVIOR tour platform, you agree to be bound by these Terms of Service. If you do not agree, please do not use the site or participate in fan prepurchases.

2. Description of Service & Tour Campaign Model

This platform enables fans to express demand for tour cities, hold tier-locked prepurchase spots, earn loyalty points, participate in rewards, and receive tickets when tour stops are confirmed. Shows are contingent upon reaching designated fan demand thresholds and venue availability, and are not guaranteed until officially confirmed.

3. Payment Processing Models, Charges & Authorizations

Transactions on TurnUpTour operate primarily under our deferred card authorization model, with immediate payment fallback when explicitly configured:

• Deferred Card Authorization / Card Vaulting (`DEFERRED_AUTHORIZATION`): Saving a card vaults an authorization consent token with our PCI-DSS Level 1 payment provider (Airwallex or Stripe) with $0 charged at registration. Your card is charged for the locked ticket price ONLY if your selected city reaches its threshold target and is confirmed. You will receive an email notice prior to batch collection.
• Immediate Payment (`IMMEDIATE_PAYMENT`): Direct payment collection at checkout for immediate ticket issuance or deposit campaigns.

4. Refund & Cancellation Policy

Our refund policy is strictly aligned with the active payment processing model and applicable consumer protection regulations:

• Unconfirmed Cities (Deferred Authorization): If a city does not meet its threshold target or is cancelled prior to confirmation, all saved commitments are closed with $0 charged. Because zero funds were collected, no refund processing is necessary.
• Confirmed & Paid Reservations: Once a batch payment is collected upon show confirmation, ticket fulfillment executes automatically. If an officially confirmed show is later cancelled prior to performance by the artist or venue operator, 100% of collected ticket funds are refunded to the original payment method.
• Statutory Consumer Rights: Customers in the EU/UK retain mandatory statutory consumer withdrawal rights prior to ticket issuance. Refunds process back to the original payment card within 5–10 business days.

5. User Conduct & Anti-Abuse

Users agree not to engage in fraudulent or abusive practices, including: creating multiple accounts to manipulate referral leaderboards, submitting automated registrations, or attempting to compromise platform security. TurnUpTour reserves the right to void fraudulent entries and forfeit associated rewards.

6. Official Sweepstakes & Raffle Rules

TurnUpTour may host giveaways or raffles (“Sweepstakes”). NO PURCHASE OR PAYMENT IS NECESSARY TO ENTER OR WIN. A purchase will not increase your chances of winning. Entries may be earned through loyalty points, completed missions, or via our Free Alternative Method of Entry (“AMOE”). All entry paths carry equal odds of winning.

7. Referral Program & FTC Compliance

Participants in referral reward programs must comply with FTC Endorsement Guides. If sharing a referral link or promoting the campaign for potential cash or point rewards, you MUST clearly and conspicuously disclose your financial connection using prominent disclosures such as #ad, #TurnUpTourPartner, or #EarnedCommission.

8. Mobile Messaging & SMS Terms (TCPA Compliance)

By opting in to SMS alerts, you consent to receive automated operational and promotional text messages. Message and data rates may apply. Consent is not a condition of purchase. You may opt out at any time by replying STOP. Reply HELP for assistance.

9. Limitation of Liability

The service is provided on an “as is” basis. TurnUpTour and the touring entity are not liable for indirect, incidental, or consequential damages resulting from platform use or third-party venue modifications.
